These Terms and Conditions govern the use of the website and the purchase of any products from Need A Sign (referred to as “We,” “Us,” or “Our”). By placing an order, you agree to be bound by these terms.

1. General Terms
1.1. Acceptance of Terms: These Terms and Conditions apply to all orders placed by you (the “Customer”) through our website or via any other method.
1.2. Governing Law: These terms are governed by the laws of the state of Victoria, Australia.
1.3. Amendments: We reserve the right to amend these Terms and Conditions at any time. The terms in effect at the time of your order will apply to that purchase.

1.5 We reserve the right to terminate or discontinue any product lines and services currently being provided on this website temporarily or permanently, any time, without prior notice.

2. Ordering and Payment
2.1. Price: All prices listed on the website are in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated.
2.2. Order Confirmation: An order is deemed accepted and binding only after we issue an official email confirmation and payment has been successfully processed.
2.3. Payment: Full payment is required at the time of placing the order unless explicitly agreed otherwise. We accept all major credit cards and other payment methods displayed on our website.
2.4. Quotations: Written quotes provided are valid for 30 days from the date of issue unless specified otherwise.
2.5. Typographical and Pricing Errors:Â In the rare event that a Need A Sign product is listed with an incorrect price or erroneous product information (a typographical error), we reserve the right to refuse or cancel any orders placed for the product listed at the wrong price. This reservation of right applies regardless of whether the order has been confirmed or if your payment method has already been charged. Should your order be refused or cancelled after your credit card or other payment method has been charged, Need A Sign will promptly issue a full refund back to your original payment account for the amount of the incorrect price.

3. Artwork and Proofing
3.1. Customer Responsibility: The Customer is solely responsible for supplying print-ready artwork that meets our published specifications (resolution, colour mode, sizing, etc.).
3.2. Colour Accuracy: While we strive for colour accuracy, final printed colours may vary from colours viewed on a digital monitor. We do not guarantee a perfect colour match unless a specific Pantone colour is provided and explicitly agreed upon.
3.3. Artwork Approval (Proofing): If a digital proof is provided, the Customer must carefully review and approve it. Approval confirms that all design elements, content, spelling, and sizing are correct. Once approved, the job is sent to production, and the Customer accepts full responsibility for any errors in the final product.
3.4. Alterations: Any changes requested after final artwork approval may incur additional costs and will delay the quoted production timeline.

4. Production, Delivery, and Risk
4.1. Production Times: Production lead times are quoted in working days and commence only after full payment has been received and final artwork approval has been confirmed. Production times are estimates and not guarantees.
4.2. Delivery: We use third-party carriers for all deliveries. Delivery times are estimated and are not guaranteed. We are not liable for delays caused by the courier service.
4.3. Risk and Title: Risk of loss or damage to the product passes to the Customer upon dispatch from our premises. Title to the goods remains with Need A Sign until full payment has been received.
4.4. Packaging: Due to the nature of our products, specialised packaging may be required to ensure safe transport. This cost may be included in the shipping charge.

5. Warranties and Limitation of Liability
5.1. Product Warranty: We warrant that the goods supplied will be free from material defects for a period of twelve (12) months from the date of dispatch under normal use. This warranty does not cover damage resulting from improper installation, misuse, extreme weather, or unauthorised modification.
5.2. Liability Limit: To the extent permitted by law, our total liability for any claim arising from an order shall not exceed the total price paid by the Customer for that specific product.
5.3. Australian Consumer Law: Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.
5.4. Assumption of Risk: The Customer’s use of the Need A Sign website and the services offered is entirely at your own risk. We do not guarantee that the website will be free from errors or interruptions, or that the website and its servers will be free of viruses or other harmful components. We are not responsible for any damage or loss resulting from your reliance on information or content obtained through the website.

6. Returns, Refunds, and Cancellations
6.1. Custom Products: Due to the custom-nature of the products, orders cannot be returned or refunded unless the item is: a) Found to be materially defective (outside of acceptable tolerance). b) Significantly different from the approved artwork proof.
6.2. Claims: Any claims for defects or errors must be submitted in writing within seven (7) days of receiving the product, accompanied by clear photographic evidence.
6.3. Cancellations: Once an order is confirmed, it cannot be canceled or changed if production has commenced. If cancellation is possible, a fee covering any costs incurred (materials, artwork time, administrative fees) will be deducted from any refund.
6.4. Incorrect Goods: If you receive incorrect goods or quantity, you must notify us immediately so we can arrange for correction at our expense.
